Resolution of Status Visa
The Australian government has introduced a new permanent visa for TPV or SHEV holders called the permanent Resolution of Status visa (RoS visa). This visa allows holders to stay in Australia indefinitely. You become an Australian Permanent Resident on the day the RoS visa is granted.
Who is eligible?
Only TPV and SHEV holders who first arrived in Australia before 14 February 2023 are eligible to apply for the RoS visa. TPV or SHEV holders who first arrived in Australia on or after 14 February 2023 are not eligible for a RoS visa. However, these visa holders can now apply for a subsequent TPV or SHEV. To remain lawful, you must apply before your current TPV or SHEV expires.
Who is ineligible?
Visa holders who are subject to an application bar are not eligible to apply for a RoS visa while that bar is in place. A small group of TPV and SHEV holders will be contacted by the Department and provided with a bar lift notification letter and RoS application form. This group will mainly include those whose TPV or SHEV is due to expire soon. You will not be eligible to apply for a RoS visa if your most recent TPV or SHEV application was cancelled or refused and finally determined.
How to Apply?
From late March 2023, all eligible TPV and SHEV holders will be able to apply online for a RoS visa. Family members may apply together on the same application form, however each applicant must meet the requirements for the grant of the visa in their own right. It is expected that the majority of TPV/SHEV holders who meet the requirements for the grant of a RoS visa will be granted within 12 months of processing commencement.
If you already applied for a subsequent TPV or SHEV before 14 February 2023, the Department will automatically convert your application into an application for a RoS visa. Your current TPV or SHEV will remain valid until you receive a decision on the outcome of the application for a RoS visa.
Bridging visa holders who applied for a TPV or SHEV before 14 February 2023 will have their application automatically converted to a RoS visa application if they are found to satisfy the requirements for the grant of a TPV or SHEV.
If you are currently an unlawful non-citizen, an application for a RoS visa is also taken to be an application for a bridging visa.
To apply for a RoS visa you must be in Australia at the time of application lodgement and at the time of visa grant. You must meet the security, health and character requirements for a RoS visa.
What you can do with a ROS VISA?
If you are granted a RoS visa, you can:
• Live, work and study in Australia permanently
• Access benefits from Services Australia and Medicare
• Access short-term counselling for torture and trauma if required
• Sponsor eligible family members for permanent residence through the family visa stream
• Travel to and from Australia for 5 years
• If eligible, become an Australian citizen
• If eligible, attend English language classes for free
